The subject of the contract is the sale of digital content (motion visuals, VJ loops, video and image files) for non-exclusive use.

4. Copyright & Usage Terms
All digital works offered in LU Productions Shop on Payhip (including motion visuals, VJ loops, animated videos or image files) are protected by copyright and remain the intellectual property of Ella Lugin.
By purchasing a digital artwork, you acquire a non-exclusive, non-transferable license for personal or professional use (e.g. as a VJ visual or background in a performance).

The following actions are strictly prohibited:
– Copying, modifying or distributing the files to third parties
– Uploading to any blockchain platform (e.g. for NFT creation or tokenization)
– Any resale or commercial reuse beyond the granted scope of use
- Reselling, sublicensing, or publishing on media platforms is not permitted without prior written consent. Any violation of these terms constitutes copyright infringement and may be subject to legal action.
​​- Resale on digital marketplaces is allowed, except on blockchain-based NFT platforms, which require explicit licensing. NFT minting rights are not included in this purchase. Please contact the artist for authorization.

5. Prices & Payment
All prices are in the currency specified in the shop and do not include VAT (in accordance with small business regulation, if applicable). Payment is made via the methods offered in the shop.

6. Delivery of Digital Content
After successful payment, the customer receives a download link via email or direct access through their user account. There is no physical delivery.

7. Right of Withdrawal for Digital Content
By purchasing, the customer explicitly waives the right of withdrawal (§ 356 para. 5 BGB) as the product is a digital good that is made available immediately.

8. Disclaimer of Liability
Ella Lugin assumes no liability for damages resulting from improper use of the content. No responsibility is taken for technical issues on third-party platforms.

9. Privacy & Data Protection
Personal data is used exclusively for processing the transaction and is not shared with third parties. For more information, please refer to the Privacy Policy.

10. Terms for Patrons Club Membership
By purchasing a Patrons Club membership, the customer gains access to exclusive digital content and, if applicable, personal interactions (e.g. video calls or in-person meetings). The specific benefits and content are outlined in the product description at the time of purchase.

The membership is personal, non-transferable, and valid for the duration stated in the respective tier. Refunds are excluded, except in cases required by law.

The works received within the scope of membership are subject to copyright and remain the intellectual property of Ella Lugin. The works will be submitted by downloadlink.
Resale of these works (e.g. to collectors or on secondary markets) is permitted, provided the artwork remains unaltered, the artist is clearly credited, and the use complies with these terms. Uploading to blockchain platforms or publishing the work as an NFT is only permitted with the explicit written consent of the artist. A separate NFT usage agreement must be signed. Resale on digital marketplaces is allowed, except on blockchain-based NFT platforms, which require explicit licensing. NFT minting rights are not included in this purchase. Please contact the artist for authorization.
Ella Lugin reserves the right to change or discontinue membership content or benefits with prior notice, for artistic, technical, or organizational reasons.

10. Applicable Law & Jurisdiction
Swiss law shall apply. Place of jurisdiction is Zurich, unless otherwise required by law.

4. Urheberrecht & Nutzungsrechte
Alle im LU Production Shop auf Payhip angebotenen digitalen Werke (insbesondere Motion Visuals, VJ-Loops, animierte Video- oder Bilddateien) sind urheberrechtlich geschützt und bleiben geistiges Eigentum von Ella Lugin. Mit dem Kauf eines digitalen Werkes wird ausschließlich ein einfaches, nicht übertragbares Nutzungsrecht zur persönlichen oder professionellen Verwendung (z. B. als VJ-Visual oder Hintergrund in einer Performance) erworben.
Nicht gestattet sind insbesondere:
– Vervielfältigung, Bearbeitung oder Weitergabe an Dritte
– Upload auf Blockchain-Plattformen (z. B. zur Erstellung oder zum Verkauf als NFT oder Tokenisierung)
– jegliche kommerzielle Weiterverwertung außerhalb des vereinbarten Nutzungsrahmens
Ein Weiterverkauf, eine Lizenzweitergabe oder Veröffentlichung auf Medienplattformen ist ohne ausdrückliche, schriftliche Genehmigung untersagt. Verstöße gegen diese Nutzungsbedingungen stellen eine Urheberrechtsverletzung dar und können rechtlich verfolgt werden.

Ein Upload auf Blockchain-Plattformen oder die Veröffentlichung als NFT ist ausschließlich mit ausdrücklicher, schriftlicher Einwilligung der Künstlerin erlaubt. Hierzu wird eine separate NFT-Nutzungslizenz abgeschlossen. Der Wiederverkauf auf digitalen Marktplätzen ist erlaubt, mit Ausnahme von Blockchain-basierten NFT-Plattformen. Für diese ist eine ausdrückliche Lizenz erforderlich. Das Recht zur Erstellung eines NFTs (‚Minting‘) ist in diesem Kauf nicht enthalten. Bitte kontaktiere die Künstlerin für eine Genehmigung.

5. Preise & Bezahlung
Alle Preise verstehen sich in der im Shop angegebenen Währung und enthalten keine Umsatzsteuer (gemäß Kleinunternehmerregelung, sofern zutreffend). Die Bezahlung erfolgt über die im Shop angebotenen Zahlungsmethoden.

6. Lieferung digitaler Inhalte
Nach erfolgreicher Zahlung erhält die Kundin/der Kunde einen Download-Link per E-Mail oder direkten Zugriff über das Benutzerkonto. Es erfolgt kein physischer Versand.

7. Widerrufsrecht für digitale Inhalte
Mit dem Kauf verzichtet die Kundin/der Kunde ausdrücklich auf das gesetzliche Widerrufsrecht (§ 356 Abs. 5 BGB), da es sich um sofort nutzbare, digitale Inhalte handelt.

8. Haftungsausschluss
Ella Lugin übernimmt keine Haftung für Schäden, die durch unsachgemäße Nutzung der Inhalte entstehen. Für technische Fehler auf Drittplattformen wird keine Verantwortung übernommen.

9. Datenschutz
Personenbezogene Daten werden ausschließlich zur Vertragsabwicklung verwendet und nicht an Dritte weitergegeben. Weitere Informationen findest du in der Datenschutzerklärung.

10. Bedingungen zur Patrons Club Mitgliedschaft
Mit dem Erwerb einer Patrons Club Mitgliedschaft erhält die Kundin/der Kunde Zugriff auf exklusive digitale Inhalte und gegebenenfalls persönliche Leistungen (z. B. Videoanrufe oder persönliche Treffen). Die genauen Inhalte und Leistungen ergeben sich aus der jeweils beim Kauf dargestellten Leistungsbeschreibung.

Die Mitgliedschaft ist personengebunden, nicht übertragbar und gilt für die jeweilige Laufzeit gemäß der gewählten Mitgliedschaftsstufe. Rückerstattungen sind ausgeschlossen, außer bei gesetzlich zwingenden Gründen.

Die im Rahmen der Mitgliedschaft erhaltenen Werke unterliegen dem Urheberrecht von Ella Lugin. Die Werke werden per Downloadlink übermittelt.
Ein Weiterverkauf dieser Werke (z. B. an Sammler oder auf Sekundärmärkten) ist gestattet, sofern das Werk im Originalzustand bleibt, die Künstlerin als Urheberin klar genannt wird und kein Verstoß gegen die Nutzungsbedingungen erfolgt.

Ella Lugin behält sich das Recht vor, Leistungen oder Inhalte im Rahmen der Membership nach vorheriger Ankündigung anzupassen oder einzustellen, sofern dies aus künstlerischen, technischen oder organisatorischen Gründen erforderlich ist.

11. Anwendbares Recht und Gerichtsstand
Soweit gesetzlich zulässig, gilt der Gerichtsstand Zürich, Schweiz. Für Sammler mit Wohnsitz im Ausland gilt der gesetzliche Gerichtsstand ihres jeweiligen Wohnortes.
